Terms of Service

These Terms govern your use of the ATAP AI platform and websites at atapai.com and ai.atapai.com. By creating an account, using the service, or agreeing to receive messages from us, you accept these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to do so.

1. The service

ATAP AI provides customer-service and business-operations software, including an AI assistant, ordering and delivery tools, scheduling and time tracking, and messaging to customers on behalf of the businesses that use our platform.

2. Our role — you buy from the merchant, not from us

ATAP AI is a platform. We provide software that helps you find businesses, ask questions, place orders and receive updates. Any purchase, booking, delivery or service you obtain through the platform is a contract directly between you and that merchant. We are not the seller or the supplier, we are not a party to that contract, and we do not act as agent for either side.

In practice that means:

The merchant is responsible for its own goods and services — description, quality, pricing, availability, fulfilment, delivery, returns, refunds, warranties, and compliance with the law.
We do not control, supervise, endorse or guarantee any merchant, and we do not independently verify every claim a merchant makes about itself or about what it sells.
Prices, promotions, opening hours, stock and product information come from the merchant. Where our assistant repeats that information, it is passing on what the merchant supplied.
Any dispute about an order, a refund, a delivery, or the quality of what you bought is between you and the merchant. We are not responsible for a merchant's acts or omissions, including misrepresentation, non-delivery, or fraud.

We may remove a merchant from the platform where we consider it appropriate. Doing so does not make us a party to anything that merchant did, and allowing a merchant onto the platform is not a warranty about them.

If there is a dispute

We would rather help than hide behind this section. If you are in dispute with a merchant, contact us and we will do what we reasonably can — putting the parties in touch, and confirming what our own records show about an order, a delivery or a message.

We cooperate — with proper legal direction. We will comply with a subpoena, court order or other valid legal process, and will assist all parties to the best of our ability where a court directs it. We will not hand over another person's personal information, account records or communications simply because someone asks. Requiring legal direction protects you exactly as much as it protects anyone else — it is the same standard we apply when the request is about you.

3. Accounts

You are responsible for the accuracy of the information on your account.
You are responsible for keeping your credentials secure and for activity under your account.
You must tell us promptly if you believe your account has been accessed without permission.
Accounts are for the person or business they are issued to, and may not be shared or resold except under a licensing agreement with us.

4. Text messaging terms

This section applies to anyone who receives SMS or MMS messages from ATAP AI or from a business using our platform.

What we send

Program name	ATAP AI Notifications
What you receive	Transactional and operational messages only: order confirmations and status, delivery notifications and driver updates, appointment and reservation confirmations and reminders, waitlist notifications, account and security notices, and staff scheduling alerts.
Message frequency	Varies with your activity. You receive messages in response to something you or the business you deal with has done — there is no fixed schedule and no recurring broadcast.
Cost	We do not charge for messages. Message and data rates may apply from your mobile carrier.

How you opt in

You opt in by giving your mobile number and agreeing to receive text messages — when placing an order, booking an appointment or delivery, registering an account, or by texting us first. Consent to receive messages is not a condition of purchasing anything.

How you opt out

Reply STOP to cancel. Reply HELP for help. Replying STOP to any message ends text messages to that number. You will receive one confirmation that you have been unsubscribed, and nothing after that. To restart, reply START or ask the business to opt you back in.

You may also contact us at info@atapai.com to be removed. Opting out of text messages does not close your account and does not stop email or in-app notices you still need.

Carriers and delivery

Message delivery depends on your mobile carrier and we cannot guarantee it. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

Your privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy.

5. Acceptable use

You may not use the service, and businesses using our platform may not use our messaging, to:

Send unsolicited marketing, bulk messages, or anything to a person who has not opted in.
Send messages to a number after that person has replied STOP.
Send content that is unlawful, deceptive, harassing, hateful, or that promotes illegal goods and services, including any category prohibited by mobile carriers.
Impersonate another person or business, or misrepresent who a message is from.
Attempt to gain unauthorised access to the service, or interfere with its operation.
Scrape, resell or redistribute data from the platform.

Businesses using our platform are responsible for obtaining and recording consent from their own customers before any message is sent, and for honouring opt-out requests immediately. We may suspend messaging for any account that does not.

6. Fees and cancellation

Paid plans and subscriptions are billed in advance for the period shown at purchase.
You may cancel at any time from your account or by contacting us. Cancellation takes effect at the end of the current billing period, and the service continues until then.
Unless stated otherwise at purchase or required by law, fees already paid are not refundable.
We will give reasonable notice before changing prices.

7. Your content

You keep ownership of the content you put into the service. You grant us the licence needed to host, process and display it in order to provide the service. You are responsible for having the right to submit that content, including any photograph containing a person.

8. AI-generated responses

Parts of the service generate answers automatically. These can be wrong or incomplete. Answers are provided for convenience and are not professional, legal, medical or financial advice. Check anything that matters before relying on it.

9. Suspension and termination

We may suspend or close an account that breaches these Terms, creates a security or legal risk, or uses messaging in a way that puts our carrier standing at risk. Where circumstances allow, we will give notice and an opportunity to put it right. You may close your account at any time.

10. Disclaimers

The service is provided "as is" and "as available". To the extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

11. Limitation of liability

To the extent permitted by law, ATAP AI is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

12. Changes to these Terms

We may update these Terms. If a change is material we will update the date above and give notice in the platform or by email. Continuing to use the service after a change means you accept it.
